This legal notice (hereinafter the "Legal Notice") governs the use of the Internet portal service "www.renfe.es" (hereinafter the "Portal") that the public corporation Renfe-Operadora (hereinafter "the Company") puts at the disposal of Internet users.
The public corporation Renfe-Operadora is a public institution as defined in Article 43.1.b) of the General State Administration Organisation and Operation Act 6/1997 of 14 April, and is attached to the Ministry of Public Works (Ministerio de Fomento).
Renfe-Operadora has its own legal personality separate from that of the State, full capacity to act in the attainment of its corporate purpose, and its own property and assets, under the terms established in the third additional provision of the Railway Sector Act 39/2003 of 17 November, and according to the terms stipulated in its own Articles of Association, which were approved by Royal Decree 2396/2004 of 30 December (published in the Official Gazette on 31 December).

2. 1. General information
The use of the Web page www.renfe.es confers the status of user (hereinafter the "User") and implies full and unreserved acceptance of each and every provision included in this Legal Notice in the version published by Renfe-Operadora at the time the User accesses the aforementioned Web page. The User must therefore read this Legal Notice carefully whenever he or she intends to use the Web page, since changes may be made to this Legal Notice.
The use of certain services offered to the Users through the Web page is subject to specific particular conditions (hereinafter the "Particular Conditions") which, depending on the circumstances, replace, complete and/or modify this Legal Notice. Therefore, prior to using such services, the User should also carefully read the corresponding Particular Conditions.
Renfe-Operadora informs you that access to and use of the Web page www.renfe.es and all the subdomains and directories included under this page (hereinafter named collectively the Portal), as well as the services that may be obtained through this page, are subject to the terms and conditions stipulated in this Legal Notice. Therefore, if you do not agree with the conditions detailed herein, please do not use the Portal, since any use of the Portal or of the services included therein will imply the acceptance of the legal terms in this text.
The Portal aims to promote the activities and services of Renfe-Operadora, and thus the information contained herein is designed mainly to inform the User of the services being offered, and in any case merely constitutes an invitation to contract, not a binding offer. All the products and services contained in the Portal are provided by Renfe-Operadora in accordance with the current regulations.
Renfe-Operadora reserves the right to make changes in the Portal without previous notice in order to update, correct, modify, add or delete the Portal content or its design. The Portal content is updated on a regular basis, and because the updating of the information is not done immediately, we suggest that you always check the validity and accuracy of the information contained in the Portal, since in the event of discrepancy between the printed documents published officially by Renfe-Operadora and the electronic version published in this Portal, the former shall prevail.
The content, commercial activities, products and services included in the Portal are not designed for, or aimed at persons who reside in jurisdictions where its content is not authorised.
2. 2. Free use of the Portal
Use of the Renfe-Operadora Portal is offered free of charge to the Users. However, some of the services provided by Renfe-Operadora through the Portal are subject to a charge, as determined in the corresponding Particular Conditions.
2.3. User registration
As a general rule, it is not necessary for the Users to subscribe or register previously in order to make use of the services. However, Renfe-Operadora makes the use of some of the services conditional to the prior completion of the corresponding User registration. This registration must be completed as indicated expressly in the service itself or in its Particular Conditions.
2.4. Obligation to make proper use of the Portal, the services and the content
The User agrees to use the Portal, services and content offered in accordance with the law, this Legal Notice, the Particular Conditions of certain services, and the other notices, guidelines for use and instructions made available, and also with generally accepted standards of ethics, integrity and public order. Thus the User shall refrain from using any of the services and/or content for unlawful purposes prohibited in this Legal Notice which may be detrimental to the rights and interests of third parties, or which may in any way harm, render useless, overload, damage or prevent normal use of the services, the computing equipment or the documents, files and all kinds of content stored on any computer system (hacking or software piracy) of Renfe-Operadora, other Users or any Internet user (hardware and software).
Renfe-Operadora reserves the right to bring appropriate legal action against any Users who infringe the agreement indicated in the preceding paragraph.
2.5. Links or hyperlinks
Renfe-Operadora may provide access to other Web pages which we believe may be of interest to the User. The sole purpose of these links is to make it easier for the User to find the resources he or she may be interested in on the Internet. However, these pages do not belong to Renfe-Operadora, nor does Renfe-Operadora review their content, and therefore Renfe-Operadora cannot assume responsibility for the content, the operation of the linked page or any possible damages that may result from access to that page.

Renfe-Operadora may at any time withdraw the authorisation mentioned in the preceding paragraph without having to state a reason. In such case, the page that established the link must remove it immediately as soon as the notification of the authorisation cancellation by Renfe-Operadora is received.
Renfe-Operadora expressly prohibits third parties from applying frames or using any other mechanisms that alter the design, original configuration or content of its Portal.
Renfe-Operadora abides by Act 15/99 governing the protection of personal data.
Both the Portal design and its source code, and the logos, brands, drawings, models and other distinctive signs that appear in the Portal belong to Renfe-Operadora or to its partners and are protected by the corresponding intellectual and industrial property rights. The Portal content is likewise protected by the intellectual property rights of Renfe-Operadora or third parties. Their use, reproduction, distribution, public communication, offering, transformation or any other similar activity is strictly forbidden without the express authorisation of Renfe-Operadora, or unless such use is made strictly in accordance with the terms deriving from the contracting of the services offered through the Portal. Renfe-Operadora reserves the right to bring appropriate legal action against any Users who infringe its intellectual and/or industrial property rights.
Portal usage: access to the Portal and proper use of the information contained therein are the responsibility of the User, and Renfe-Operadora takes no responsibility for any improper, illegal or negligent use by the User.
Content use: Renfe-Operadora provides all the content in its Portal in good faith and shall endeavour to ensure that it is permanently up-to-date and current; however, Renfe-Operadora assumes no responsibility for any use or access by the Users outside the scope of the Portal, which will at all times be the responsibility of the User. Any User who acts against the image, good name or reputation of Renfe-Operadora, or who makes any illegal or fraudulent use of the designs, brands, logos or content of the Portal, shall be responsible vis-à-vis Renfe-Operadora for such actions. Therefore, the User must refrain from obtaining or attempting to obtain information, logos, tones, images, drawings, brands, sound files and any other sound and/or graphic material accessible through the Portal by means of mechanisms other than those specified in this Legal Notice and in the Portal.
Viruses: Renfe-Operadora undertakes to apply all the measures needed to ensure the absence of viruses, worms, Trojan horses and similar code in its Portal. However, these measures are not failsafe and Renfe-Operadora cannot therefore completely guarantee the absence of such harmful code. As a result, Renfe-Operadora takes no responsibility for any damages that such code may cause to the User.
Technological failures: Renfe-Operadora shall endeavour to prevent any disruption in the Portal, but cannot guarantee the absence of technological failures or permanent availability of the Portal and the services contained therein and, in consequence, assumes no responsibility for the damages that may arise owing to unavailability and to access failures caused by disconnections, breakdowns, overloads or network problems which are not attributable to Renfe-Operadora.
Contracting errors: should the User make a mistake when entering the data needed for contracting a service owing to a message being sent with a wrong alphanumeric code, the User will not received the contracted service, without this involving any responsibility on the part of Renfe-Operadora.
Any dispute or conflicting construction of the terms that make of this Legal Notice, as well as any other matter related to the services offered in this Portal, shall be settled in accordance with the Spanish law.
